The Parties undertake to treat all information, pictures, drawings and documentation related to the Project in a confidential manner, and not to use any of this information, pictures, drawings or documentation for other means than the accomplishment of the Project.

However, any information or documentation which fulfils the below conditions will not be considered confidential: any information or documentation which:

1. is or becomes public knowledge (other than by breach of this Clause);
2. was in the possession of the receiving party, without restriction as to its disclosure, before receiving it from the disclosing party;
3. is received from a third party which lawfully acquired it and who is under no obligation restricting its disclosure;
4. is independently developed without access to any confidential information; or
5. must be disclosed pursuant to a statutory or legal obligation placed upon the Party making the disclosure.

The restrictions contained in this Clause shall continue to apply for three (3) years up from the submission of the Project information in the APP.
